Going to the grey's would wipe out the common shareholder, but it would also wipe out dealers and distributors who are connected to HJOE through share purchase. It is inconceivable at this point that they would even risk it.
I'm still wondering why the general perception is this is going to trial? KBM is a dirty hand. HJOE seems to have some solid proof of their underhandedness and fraudulent activities. Why would HJOE wish to extend this out into a costly legal battle? Why would KBM risk losing a cash settlement? Forget shares, it won't happen, but a cash payout? May 5th is fast approaching and that is a mediation date with the judge as per the court filings. I still would not be shocked with a settlement and KBM going away with tail tucked and no shares.
I believe filings are a done deal sometime EOY, their earning will be too strong not to boast about.
