No, CTIX did have significant costs -- typically the client has to pay all costs up front like filing fees, etc., photocopying, and remember that Leo had to fly up to NY on numerous occasions. Law firms often ask 15 or 20 cents a page for things like xeroxing -- actually not unreasonable given that they have an employee who stands there and does it. And there is NO way that Sullivan would mention significant costs if they could not be documented. The judge will ask for a detailed accounting of billable hours and all expenses if she decides to award $$ to CTIX. Plus, the value of the warrants is a significant cost -- CTIX valued them at 340,000 bucks at the time of issuance.
There is also another interpretation of "giving up patents" -- that CTIX did not pursue some new patents because of the significant expenses involved in researching and preparing compounds for patent, and then the VERY LARGE amount of time it takes to prepare the filing. And that doesn't even include the VERY LARGE legal fees that good patent lawyers charge. I know this because I have a fairly uncomplicated patent and it was horrifically expensive.
