I have a hard time seeing how a lawsuit against Mako and SA would discourage new investors as well! I would really prefer the suit to be handled by investigators as a class action/contingency based suit though. Law firms have an inherent advantage in that it mostly costs them time and effort to proceed with their lawsuits. If someone is paying a firm to represent them the bill usually ends up getting inflated so quickly that the most you can hope for is a moral victory, that might feel good but funds would be better spent on clinical trials than defamation trials IMO.
