You're assuming a lot there...as in the ONLY motive for not settling yet must be that Amarex thinks they have merit. That implies they're acting in good faith, 'on the merits', which is completely NOT their proven MO thus far.

How many cases have been settled 'on the courtroom steps' after months/years of fronting/stonewalling by the defendants, *especially* when they're trying to bully/exhaust the already-exhausted plaintiffs...

tl;dr: It could *easily* be all fronting.
