Amarex wants to drag this out as long as possible. They’re going to want to try to sign as many contracts as they can before a settlement is announced — which certainly might make prospective clients think twice before hiring Amarex. And, the longer they drag it out, the longer they have the use of their money. Of course, the biggest reason to drag it out is to try to get CYDY to take a lesser settlement, because of the expense of hiring Sidley-Austin (though I suspect that a contingency deal may be part of this for CYDY), and also, the time value of money for CYDY.
Amarex will want to settle for the least money possible, and it is not unreasonable to assume that they will also want a non-disclosure agreement, to try to salvage what Amarex can of its reputation.
