According to the SEC complaint: "And, in a text message on February 24, 2020, Pourhassan told Kazempour that he was “really in need of your help with our BLA. We signed an extra work order of about $150k so we could get it done by the end of JANUARY and now we are at the end of FEBRUARY and I am losing a lot of credibility among our shareholders.”
Given Amarex charged CYDY an additional $150k to complete the BLA by the end of February, and given the massive amount of data that was still missing from the BLA when they submitted it at the end of February, it shows a significant level of incompetence and/or fraud on the part of Amarex. In my opinion, NP's desperate and fraudulent request to submit the BLA knowing it was incomplete doesn't justify Amarex's poor performance and excuse them from their contractual obligations to CytoDyn.
