I don't know the answers to these questions, but have this as a reply to your questions.
When someone, as a few participants on here tried, ask the SEC whether or not an investigation is currently happening in regards to a specific company, they always reply that they will not comment on whether or not an investigation is going on.
So if the SEC itself is not willing or able to comment, I am sure that they are making sure that the company officials are doing the same.
In order for them (SEC) not to give them (company) another avenue to breach such a gag order, I can believe that they are ordering them not to publish their reports as well.
