I find it very hard to believe that the fact of the investigation cannot be disclosed, because if there is one, the fault for the failure to file financial reports rests with the regulator. I do not think the regulator wants to assume such responsibility as the filings are not discretionary and the act in of itself a violation of SEC requirements. If you take your arguments to what you claim is a logical explanation, I find there is nothing at all logical about it.
