I remember the most recent Sidley Austin federal court filing that "Cytodyn does not wish to suppress the proxy vote, Cytodyn only wishes that shareholders are fully informed" or something to that effect.
Maybe I remember it wrong. Maybe the CYDY court filing does have deletion of the proxy as a possible outcome.
Probably the proxy deletion has not yet been requested of by CYDY, but upon more discovery CYDY can amend their complaint to include deletion of the proxy if the judge determines sufficient legal grounds for that remedy.
