Sounds good and many people suggested that Creek Mountain be made to buy back the shares. One technical problem to be worked out though - innocent people bought those shares that Creek Mountain sold and so who will pay them their dividend? And it has to be worked out that when Creek Mountain buys the shares back, they do not get the due bill attached that will give them the dividend. So that raises another problem - if Creek can't get the dividend when they buy the shares back, then how do you keep track of it all?

Jail and massive fines don't help GNBT though...the lawyers and the SEC get rich. I like Zolis' idea...if they don't want GNBT to press charges, they need to buy back the 2M shares in the open market and NOT be entitle to the Due Bill on those shares. This would need to be completed within 1 month, the amount of time they were selling illegally (I think). This would then make them back into the covenants.
