Exactly, plain and simple, saying in a 10k that your not going to meet predetermined milestones wasn’t good. But not sure he had an option. What if he didn’t mention that and then dropped it out of the blue in an 8K.
I think it’s possible his hands were tied in regard to what he could say in regard to the potential deal and term sheet, but he had to put the milestone issue out there to protect the company from BS lawsuits for not releasing the fact in a timely manner.
