So really, for me, why put out a PR with milestones and then beat around the bush in the 10-K? I read the 10-K as being VERY close to a deal. So even with 7 more trading days (after today) they could still follow though. The follow through, even into October, is all I really care about but the milestone game was a bad move imo.
