Mark confirmed last week that Ropes & Gray has already provided the Circuit Court of Appeals the needed Shock & Awe!
Wasn't it fun to watch the best of the best at work. Reading through their brief was a delight. They clearly explained why they were dropping the MOAB (4Sleddogs should be able to interpret this) on SecureAuth and the District Court.
Although I agree that we all owe a tremendous thank you to the PTAB and Supreme Court for SFOR's huge wins regarding the strength and inventiveness of SFOR patents I believe Ropes & Gray would have navigated victory anyway. I say that because they seem to only select the cases where they already know what the outcome will be before they ever start the process.
To use an analogy...it's the difference between adults and pre-schoolers....
