They can't file anything at this time with litigation in process as anything they file can and will be used, and possibly against them, in the court of law. What needs to happen is we need to be patient until the KBM mess is over, and hope that the boss speaks to us at some point with guidance. Whatever form that may be is up to them and whatever message that may be is up to them as well, including whether they do so or not.
