Yes, the toxics are in absolute 100% full control.
Like I said, they raised $1.35M in the first funding tranche. If the Company files a Registration Statement by April 29th, 2016 and it become effecitve, then they will issue an additional aggregate principal amount of $1,555,556 (including 10% OID) of Notes and Warrants to purchase 1,400,000 shares of common stock. And they will issue an additional $1,388,889 (including 10% OID) of Notes and Warrants to purchase 1,250,000 shares of common stock on the 61st day after effectiveness of the Registration Statement.

i think i must have misunderstood about the $1.35M, i thought i read that as a first payment with more money to come, thats what i got from the confusing PR. Wrong assumption of me i suppose.
Is the $1.35m enough for the trails of ESS? it sounds like its not much money.
Not that i actually know how much is needed but i would think more then that?
man i have so many questions,
