If you are long shares and sell and your account is flat then, no, you don't pay the dividend. If you are short shares then yes you pay the dividend, as you borrow those shares from a long when you sell them (if it is a legal short). If it is a naked short then you must pay the dividend to the person who bought your naked short shares and is entitled to the dividend.
