Took a few more minutes to review today's patent updates. The claims have been amended just like before. Elite is requesting the USPTO remove the rejection over obviousness. The same as before. Elite notes it will consider submitting the form to remove the double patenting issue once this happens.

The reason why imo, is so they can then argue that this should not be double patenting if they want to make that argument. Either way they get the patent.

Not sure about timelines as before there needed to be an interview and such and that is probably not needed here since they already covered these items. I expect we will see something from the examiner very soon.
