Hopefully a good law firm like we have will find the proverbial hands caught in the cookie jar of both entities and tell them the risks they have and the dollar value they are facing and will convince them that settling now is in their best interest.
Essentially tell them that we are cutting them a huge break that has a one time offer. Or we go all the way with the full gambit lawsuit and both companies are at risk of insolvency.
Sometimes when you see the end in sight as it is presented to you by some very convincing people. You listen to extend your overall survival. Self preservation takes over when you know it’s just a matter of time before your are swirling around the bowl on your last breath before you take the plunge and risk your chances of extending your survival.
Then again… I am no where close to in your lane as attorneys… just a basic survival instinct is all I have and when you weigh the odds and the situation… they look seriously guilty of all you two have stated as needed evidence. Common sense says they are smart enough to realize this also… hence… settlement would sound pretty good to them too I suspect. As long as we are reasonable and not shooting for the moon in a cash settlement. This could be over before long. Not extend a decade.
