Firms like Sidley have many qualified, non-partner lawyers working 100+ hour weeks to hammer out the details on any given case. The partners in the firm are the big dogs. The Ohms and the Resperts, if you will. They don't just join the fight without a reason. Especially when it appears even their janitorial staff could handle it. The JLangs, if you will. So it's either a high profile case (their name in lights), precedent setting litigation (their name in history books), massive money at stake (their bank account), or their overworked and underpaid team of lawyers below them is fucking up (hard to believe given what we've seen from the different documents shared here) that would lead to the inclusion of a Hobson-level partner.
Is this a high profile case?
Not right now. A company is not meeting their contractually obligated duties and won't return property. That's nothing that hasn't happened a thousand times before. But perhaps the team handling this case has run it up the ladder that NSF and Amarex have potentially cost their client billions. Maybe they've seen some evidence there may be more here than just a he said, she said fight? Maybe the more they dig in to this case the more they see potential evidence of a much larger conspiracy to delay or destroy Cytodyn's chances at a drug approval? Regardless, Hobson's involvement is an escalation of Sidley's attention to this case and that speaks to something bigger going on.
Is this a precedent setting case?
Not right now. But if there were any meat to our collective concern that there may be a larger entity doing shady shit behind the scenes to try to destroy Cytodyn, or at bare minimum stifle their progress to the point that they give up and sell LL cheap, it could become a very important case. If it were true that some company or group were doing illegal shit to hurt CYDY and they were able to enlist NSF and Amarex in that battle, Sidley would be very eager to win a case like that and would pull out all the stops. Because CYDY is definitely not the first to go through this kind of thing. I'm not saying this is happening, just that when you add up all the negative pressure it sure does feel like it could be. And that's the kind of thing that would bring a partner down a few floors to the fight.
Is there massive money at stake?
Yes. I think it's most likely that along the way the Sidley team has recognized that there is a potential multi-billion dollar award at the end of this. Which could/would warrant the engagement of Sidley's strongest assets.
Is their team screwing up the case, requiring involvement of the partners?
No. Highly, highly doubtful given the facts of the case and the documents we've seen.
In conclusion, if this Hobson news is real there's an almost 100% probability that it's because there's a larger prize at the end of the road than originally anticipated. The original case is about return of data but this looks to be turning into something much bigger. JLang doesn't bring in a hazmat crew to clean up a couple square feet of loose fertilizer out in the garden section of his Home Depot, he grabs a broom and dustpan. And Sidley doesn't bring in a Hobson for a simple case they already look like they're about to win, they leave it to their overworked and underpaid team.
Of course I want to be rich from my investment here, but revenge against those who have purposefully stood in the way of Cytodyn's progress is nearing the same level of desire lately.
