Jake, would it make more sense if the scope of the suit were not just the release of the data withheld by Amarex, nor the payments to Amarex withheld by CYDY for failure to perform, nor even the entire amount already paid by CYDY to Amarex ($60 million, I think), but damages for Amarex's failure to help CYDY bring to market a drug that would have been/is worth billions for Covid and HIV alone? Rough example: share price for 800 million shares went from $10 to $1, which certainly would not have happened had we not received the RTF letter from the FDA. That's $8 billion in damages right there. And one can speculate what would have happened if we had approval for HIV AND Covid in the past year.
Another angle: would Sidley have been more likely to bring the heavyweight Hopson aboard if there were indications that there was purposeful mishandling of Amarex's duties, perhaps even dictated by NSF? Just asking.
