(Speaking in general here, I have no knowledge or experience in securities law, and this post does not constitute legal advice).
Don't know if the 13D were really planning to file a lawsuit or not, but sometimes better to play offense when you expect a lawsuit.
However, this may have much more to do with what the 13D group (and others) are doing, and to prevent this BS.
It is clear that they are getting better representation, finally!
Furthermore, this is a warning to others that have been throwing up BS against CYDY, that CYDY has hired a new Sheriff and they had better not mess around.
