Cut to the chase. There is NO 'maybe Trump is right'. Not according to his own AG, nor according to over 50 judges, nor according to the SCOTUS twice. To say that some judges hate Trump's cuts flies in the face of the FACT that many if not most are GOP appointed and many of those under Trump. And of course the SC has a conservative majority with 3 Trump appointed judges.
You need an insurrection to invoke the Act. So far the only side insurrecting is doing so on behalf of Trump.
