Would a suit against CMF be funded by shareholders

Would a suit against CMF be funded by shareholders in advance, or is something like this usually done on a contengency fee basis?

Also, why isn't the remedy of demanding that CMF repurchase the shares being discussed? I have mentioned it twice and no one has responded. We could immediately (Monday) threaten legal action (a suit) unless they repurchase the shares.
