I am sure you remember when I threw out those two recent cases that had been decided by the same court, in fact Judge Reina from the DECN panel being one of the deciders. By the way he was very helpful from the bench to DECN yesterday. Anyway, late last week I posted on two message boards about one of these two cases, the Eli Lilly case in particular was spot on to the case DECN was arguing yesterday. I did so for a reason.

I listened to the archived hearing again. I picked up the first time how helpful Judge Reyna was to Pharmatech, but on listening again, I was even more impressed that he helped clarify Pharmatech's case immensely. His summary re. "'current time" or real time measurements seems to be the crux of the matter, and he helped steer the conversation that way several times.

The Lifescan attorney also stated regarding the recent Eli Lilly ruling, that "I beg to differ..." He had to say that to make his point, but yet probably didn't help his case any with Judge Reyna on the panel.

On second take, I'm much more comfortable with what went down at the hearing yesterday. I guess we'll know more in several weeks.
