Spidey, I was very pleased with DECN's lawyers. The judges changed up on their questions, probably because it will end up being more work to write a ruling on a Precedential issue (never before made law) and DECN's lawyers going first in the hearing had an opportunity to make their case. J&J's lawyers did not answer a single question, continuing their practice of being unprepared and basically throwing their jock straps into the court and saying "we're J&J and believe what we told you in our writings, not what you have just heard." There is also the issue of J&J having their second chair make the presentation. The first chair guy, I have noted, will resort to bullskat when put under pressure, the guy yesterday was just more or less silent.
I still look at it as a DECN win on points, no knockout. Two of these judges, I have noticed in the past are typically Plaintiff's judges. Judge Moore, I think will surprise J&J. I believe they directed all of their arguments at her. Never a good idea IMO.
