I am not employed by the company but you are wrong about certain message board posters not wanting to be CEO. Several want it badly, horrible bad, but they are like unleashed dogs chasing a car. What are they going to do when they catch it.
But a appellate Court reversing the District Courts decision wiul be great for a short term bump in price.
Take a look at the months September, October and November 2013.
Common sense man, if the Company had a product and IP that was 25% as valuable as you stated money would be rolling in.
Would an industry biotech expert say that? I doubt it. An industry expert would say that the company needed a tweak to their business model. The "generic strip" model wasn't working. It created a market where there wasn't one previously, but that new market did not throw off enough cash flow or profit to make up for the Medicare 2013 and 2016 changes that decimated the DME and mail order channels. But you know, it is late and I am not in the mood for a teaching moment.
At that point discovery begins and we could see a trial dragged out for 3-5 years.
Almost all of the discovery has been completed. Another major screw-up by the trial judge, and another reason why the case will settle. If J&J doesn't settle, DECN should take the ruling and roll right into the Markman hearing. But J&J will settle because they are no longer in the business and settlements are save face gestures.
