I spoke to George Waller about Ropes & Gray after the Appeal and mentioned my displeasure with their Oral argument preparation and the way they ended up handling the Appeal. Douglas Driemeyer is a fantastic attorney but seemed to have other more important cases to deal with based on what we heard during the Oral argument and George agreed with me. I asked him what Blank Rome thought and he said that he couldn't comment on it. I told him for all the promise that myself and others had in Ropes & Gray it seemed as if they didn't prepare well for the case in many of our opinions. Again, he said that he couldn't comment on it but even that fact told me a lot.
It does not surprise me to see Ropes & Gray out of it based on the foregoing but I can tell you that I will be extremely disappointed as a shareholder if Blank Rome does not take over since they filed the patents, settled with Microsoft and have had the Duo case all along.
I do want confirmation that Blank Rome is taking over...
