Alice 101 has caused numerous IP patents to become valueless even though the companies with the patents have spend millions of dollars instituting and protecting them. If allowed in its current state, the US becomes a less business friendly place to function where inventive ideas are no longer valued. The tremendous problem the courts have created is that they have through their unspoken actions but through their decisions to overturn valid USPTO/PTAB affirmed patents said that the US Patent Office' place in the US economy is not necessary. The Supreme Court wants to rectify this. So do several Senators.

The Senators working on the Alice 101 problem (Coons & Tillis) realize that if companies can steal other companies ideas and inventions the economy is dramatically impacted.

The fact that OOBA has become a billion dollar business isn't a deciding factor since there have been 100's of IP inventions that have been deemed abstract. How many of those have been adopted for use at some level? Most of them which is why they are being reviewed in lawsuit considerations which seek either a Cease & Desist or financial damages.

My take is that SFOR will probably not have another court hearing. Because Alice 35/101 is significantly hurting US technology companies which is affecting the US economy it will be fixed long before Ropes & Gray/Blank Rome spend another dollar of their own money defending SFOR's patent rights.
