This was a big reason or definitely an encouraging factor in why many of us were so confident going into the appeal but the problem which we've been discussing more recently is that the courts unfortunately don't by law have to do anything the USPTO says and that's a big factor here. Based on the articles we've been reading we know there's a push by some to fix this Alice mess but it's a question of how and when it will happen. I agree with Riskrewards in that it may end up being part of the strategy to respect the timing in our appeal in hoping that these "closed door" meetings lead to good things in clarification and fixing of Alice by the courts. You would think they could simply abide by the experts that actually award the patents in the first place and follow these new guidelines. Fortunately we did get a rule 36 and possibly because the judges are currently baffled as to how they should work through these types of cases, so we've still got a good shot as Alice is coming under more scrutiny with each passing day.
