If SCOTUS decides to hear HP INC. v. BERKHEIMER (an Alice 101 case) this year - and there's a good chance since the court asked for the Solicitor General to file briefs for the case in January of this year, there's also a good chance the decision will be overturned (83% from the federal circuit court where our case was affirmed) according to the numbers from the article below.

Supreme Court of the United States.

HP INC. v. BERKHEIMER

January 7, 2019.

The Solicitor General is invited to file briefs in these cases expressing the views of the United States.

Article about cases that SCOTUS has overturned from the ninth district court and federal circuit court:

https://www.snopes.com/fact-check/ninth-circu...verturned/

the “highest” (overturned) was the Federal Circuit court’s median of 83 percent. However, left out of both the rumors and the blog post was the fact that the average rate of accepted cases ruled upon differently by the Supreme Court than a lower circuit court was over 68 percent across all courts. So of less than one percent of all cases reviewed by the Supreme Court, 68 percent of decisions across all circuits were overturned. Eighty percent of decisions by the Ninth Circuit were overturned when escalated to the Supreme Court, but the numbers were misleading taken out of context.
