On March 17, the U.S. Court of Appeals for the Federal Circuit affirmed the U.S. Patent Trial & Appeal Board’s (PTAB) finding in favor of Ropes & Gray client Samsung Electronics in a case against Affinity Labs of Texas.
The Federal Circuit decision summarily affirmed, under Rule 36, the PTAB’s finding in inter partes review that all challenged claims of Affinity’s U.S. Patent No. 8,532,641 are invalid. The PTAB had ruled in Samsung’s favor on the challenged claims based on three different grounds, and further held that claims of Affinity’s ‘641 patent are not entitled to an earlier priority date.
A three-judge panel (Chief Judge Prost, Judge Moore and Judge Mayer) heard oral argument in the appeal on March 7 at the Federal Circuit in Washington, D.C. Ropes & Gray appellate & Supreme Court chair Douglas Hallward-Driemeier argued on behalf of Samsung Electronics.
This is the third favorable Federal Circuit ruling for Samsung in a string of three appeals by Affinity from PTAB rulings. Ropes & Gray is undefeated in its series of patent challenges against Affinity before the PTAB and Federal Circuit.
