They do not have a choice when to file, FINRA's responsibility is to the shareholders of public companies, and to protect their investments in public companies...Public companies must make certain information known in a timely manner (usually 3 days for an 8K)
However what will hold up the process is not paying filing fees, everything stops dead in the water until the fees are paid.... (think traffic ticket..... you gotta pay it at some point)
If you want to find out if they have the money for the filings ask them, they are obligated to tell you. I am sure they have a private placement outstanding to raise money for the filings. I would call them myself but I am not taking out private placements right now.
Also, I have gone through this process in the past, it is frustrating and time consuming and you are dealing with government workers with no initiative, and every response to a defect by the company can sit in the FINRA waiting list for up to 45 days depending on their workload, (which is usually jammed.)
The bottom line here is, follow the process not the share price.. share price does not matter until the company can be fully trading and it can have a market cap.. the process can have setbacks so setting a timeline on these types of investments does not work either....
I bot it, I own it, and I put it on news alert.. nothing else to do but sit and wait... providing the company has a willingness to go fully reporting.
