You mean he may be criminally charged pending a hearing. The civil litigation may follow, together with sanctions and possible suspension of his medical licence.
To say the least he was obviously not thinking with his head. He should be charged for being so fucking stupid. You don't have an affair with someone that has just attempted suicide and has obvious mental issues. Let alone with one that was at one time under your care.
