The SEC states naked shorting is illegal. With today’s technology, it’s hard for me to believe that they can’t expose NS positions when necessary. If NS positions can stay hidden forever, Overstock wouldn’t be able to expose them. The Overstock case showed NS positions can be exposed with today’s technology and other companies can learn from them if wanted.
