As mentioned here in the past.
It is believed that the $9.7M was to settle the phonefactor infringement (I dont believe they infringed much). They were a small company that found their way to MSFT People and were bought out.
MSFT didnt really infringe yet during the suit. They purchased Phonefactor and were in the process of engineering and implimenting the OOBA into their new Azure product. So the only thing MSFT was guilty of was the purchase. They delayed the release of Azure (as per posts, I didnt verify) until they settled with SFOR (or close to it). So that is where the licensing part comes in. While the fins. do not reflect income from MSFT, there may be a specific milestone MSFT has to achieve if royalties are to kick in.
But to be honest, I dont care about MSFT. there seems to be much bigger stuff happening here. But only time will tell.
