IPIX may well prevail in court (non-lawyer's opinion here) but I suspect they would not sue Amgen and the other entities trying to corral at least blocking rights to these combinations of drugs which include K or B or P. IPIX has incontrovertible rights to K, B and P.
The reasons why I do not think IPIX would sue are:
1. They can negotiate whatever price they consider to be fair and would be delighted to sell quantities of our drugs to other Pharma companies;
2. They could garner ever more potential partners; and
3. They could do good for mankind (and perhaps verterinary patients, as well) by making our drugs available thru multiple channels.
Remember too, IPIX has dozens of other promising defensin mimetic compounds to develop if and when we license (or sell) B. IPIX also has that autism drug.
