I have read DECN's response filed last night a total of four times. I am of the belief and ran my thoughts by Mr. Sensitivity who also agrees. J&J has a last ditch effort to overcome their issues due on September 18. Both Sensi and I concur that the current scoreboard is something like 28-7 in favor of DECN. J&J's 7 points are from the slight of hand that went into the Motions to Dismiss and the Summary Judgement Motion. Now J&J has sprung the trap on themselves. There is no way they can overcome these issues. So between now and September 18, J&J will prepare a legal brief that will read like something that is a cross between scoop and loanranger posts. They will use the next 3 weeks to put on paper their abject hate for DECN and Mr. Berman, and they will do this with some success. But on September 19 or 20, the score will still be DECN 28 and J&J 13, and J&J will have used up their one big chance to crush the DECN lawsuit.
