The old THC Scientific trademark fiasco is getting drummed up once again by the bashers. The trademark side show seems to be another desperate effort for those on the short bus to spin some rumor and doubt against the RFMK story. Weak. What happened was rather routine, the examiner did not find any other "CANNACIG" entries in the USPTO database so the servicemark application was changed to a "trademark" and the application simply went to the next stage of the long trademarking process, the publication. Basically RFMK has thirty days to object to the trademark, which I imagine, with their new high powered attorney at their disposal such an objection could be made. Even if it is not, once the USPTO moves to the later stages of attempting to approve the trademark, they should find that there is already a company, RFMK, using (currently) the "CannaCig" name and since THC Scientific has no product which is on the market that is called the "CannaCig", its game, set match, sorry Gary boy, RFMK beat you to the punch. In trademark law, whomever spends the few hundred dollars to open up a trademark application means nothing, what matters in the eyes of the law is who has been already using that name in the market for a product or service and in this case, RFMK already is currently selling a product with that name. Now the issue for Gary boy is that he signed an official trademark application which specifically stipulates that the he did not know of any other company which was using that name in the market, but as we know, the application was filed in August which was by the way months after the CannaCig already launched officially, not to mention months after THC Scientific cried over losing the RFMK business partnership in possibly using their Omicron design, though which later RFMK scrapped and moved over to work with HexCorp on their own new unique VI design. Hmmm, I wonder what will happen to Gary boy and THC Scientific once the USPTO gets to the later stages with the trademark application and sees that the signed application violated the terms and was disingenuous. Oh well, live and learn and do not let the dark path consume you with anger, fear and lust for revenge.
