Question for you? How did they take advantage of HJOE? As the Judge stated, they had control of paying the debt. The ball was in their court to avoid any interest charges, where was the the advantage gained from KBM when the document needed to be signed by both sides?
Now, if someone told me it was one of the only ways to get capital to keep the business running and there is pressure and cajoling and promises involved, I get it, and yes, that is part of the HJOEs response that KBM would work with them. However, the Judge was fairly descriptive in his opinion of HJOEs argument.
I don't think we are anywhere near the "smelling the roses," phase. Anything can and will happen in court and the expenses and risks have now risen for both sides.
