Only regulators or Judges can force a short to cover however recently cases no longer need to go to Federal Court so companies are able to bring suit in the State in which they are domiciled. Brokerage firms have often plead ignorence in the past but they will know they are short with the spinoff.
Whether they choose to do the right thing and cover remains to be seen.
