I'm not sure I agree that Rosen can make a claim of no damage with a recovered price. I would think that a price recovery in the face of the dismissed lawsuit only re-enforces the damage cause by the lawsuit in the first place. I would think Rosen will wants to keep pressure on sp with the hope of a continued drop in price as evidence that the market believes the company is a scam and their products don't work (Rosen's argument in the lawsuit, not my opinion in any way shape or form).
