You had zoning at the time the facility was being constructed. That is what the OMB hearing would have dealt with - whether the town was within its rights to effect a change. Largely moot because the town operates on a public interest policy and each item voted on at a council meeting states the effect it might have on the budget. This particular site was not serviced for that type of activity - one small six inch water line, no sewage but septic tanks, under serviced for power requirements, all of which would have required substantial cash outlay the town could have voted down.

There is also no proof showing expenditures in the amount (13 million+) you state. No building permits had been issued for that site for any interior infrastructure work and this was duly noted in council in September of 2014 despite Bill's claim in May it was ready to go, pharma grade facility (New York Post article unless he again was mis-quoted although he himself did not issue a release stating he was). Freedom Of Information is a wonderful thing - I pulled the permits granted in 2013 so you can as well. Please pull all the permits which show the facility was completed. The town inspector stated the two buildings were empty shells, non-operation when he visited the site in August of 2014. Just because investors claim it was finished does not mean it was. Please use your para legalese skills and pull those permits and show how the work was completed. As well do you care to entertain where all that equipment now is located? Since Jim has opened up a film studio the equipment must be somewhere. Can you find that out for us.
