Beyond that, this is more evidence of bad faith. It will make it much easier for CTIX to get damages down the road.
Judges hate to be overturned on appeal. But appeals panels (THREE judges) really hate to overturn lower court rulings. It would be impossible for them to find fault with judge Failla's carefully-researched, carefully-worded ruling.
Those guys are just digging the hole deeper for themselves.
