Pair the evacuation of senior leaders, and behind the scenes partnering process just long enough to begin BK process preparation. Then they go to the judge, and they say, your honor, look see, its confidential, but someone was looking at our stuff, all our hype was not fake etc etc, we tried our best, but circumstances were overwhelming and well darn, we were just so close.
We won't know how true or untrue the scenario above is for us until it happens. But now is the time to file because BK will be super messy and the company will want to finish before end of the year. There will likely be several extensions of the partnering deal.
On the other hand, firing the CFO could be an indication of negligence, clearing the slate, or be ordered by the potential partner if we're to maintain majority control of ESS. They won't want their $ mishandled.
Again, I don't say these things to be fact. All options for discussions, I've seen these things go all different way before and you don't even get to sniff the dirt until it hits the courts, and you'll never find out the truth. We should be highly suspicious of this move though. Wonder if Bobby will have sit on the stand if he's been removed from the company long enough. I wonder what he knows that no one else will know or be able to trace once shareholders start trying to piece it all together.
Magna, Dominion et al will have lots of amazing lawyers. We longs will probably get suckered into hiring some guy who thinks he can get us peanuts for the money we would've blown on additional shares later.
