That would not happen until the judge grants that the lawsuit could proceed.There is no reason to grant a jury trial for a case that is being dismissed ( or while a motion for dismissal is being considered)
If the case is allowed to go forward,the court will "outline the playing field" for the lawyers as to when and how things will proceed and how they (the lawyers) will be expected to meet certain deadlines.At that point the granting of a jury trial will likely occur.
