I agree with the above. I know HJOE believes this may go to trial, but pre trial bluster is something quite normal for both parties. A pissing contest is not out of the question. Judges, however, tend to not want to waste their court room time on matters they may find as trivial, outside of how the combatants feel, and worthy of a settlement. They tend to push for that first.
Granted, I believe any settlement, should it happen, will consist of a cash payment with no shares. If shares is something KBM wants and is resolute in getting, this is absolutely going to trial, because HJOE won't budge, nor should they. That doesn't mean however, that a judge won't immediately know why KBM wants those shares and squashes that as part of a settlement in the first place and continue to push for it.
Bottom line is we want the company resuming normal corporate activities which includes fundamental and financial growth, accurate reporting and the continuation of brand awareness. We can only have pieces of the full package until this situation is settled.
