Some people make bad decisions, but when other people try to cover those bad decisions up, everything gets much worse. Exponentially.
There are two things that gov't agencies do not want to be liable for in a civil suit: (1) respondeat superior/vicarious liability and (2) negligent retention, among other things. Why?? Because if those claims are proven, you can add a bunch of 0s to the amount paid out.
Proving that an entry level person committed a tort will get you some money, but that's just the bottom rung. The goal is to prove that people higher up on the rung are liable. Each rung you go up adds 0s to the pay out( (often more than one 0).
If you can prove that the higher ups were aware of the problem and did nothing to fix it, or, even worse, that they were the problem, you're looking at some serious damages.
With the higher ups and the Subcommittee on notice about this scandal, if anyone else tries to cover this up, the FAA might as well write a blank check.
