Now onto my post....everyone, including myself are trying to interpret the AC, CFR rules and rules associated with the mini.
One would believe rules are black and white, many are (i.e. running a red light, getting a 64 on a test when passing in 65, etc) but many are not carrying a lot of gray area and room for interpretation. The rules written by government regulators carry a lot of legalese. Not only that, not every enforcement employee or examiner read into rules consistently. With every process with gray there are exception processes (which I strongly believe BLTA) is in. Many examiners clearly take results (good or bad) back to the next level of management to decide because the rules are interpreted differently.
I've spent over a decade working in the securities industry and have been examined by the SEC, FINRA, State etc. In EVERY case we have clear laws, rules or regulations we either pass/fail AND, yes AND, we have ALWAYS had many situations taken from exams and brought to the next chain of commands to agree or disagree on the assessement of the exams. Note, we also were allowed to have open dialogue to support how we felt we people's abided by the laws, rules or regs.
Things CAN be reviewed under special circumstances, especially by federal regulators such as the FAA.
I hope everyone sees this as green apples to red apples. I'm not here to sit around and debate the interpretation because you can skin a cat 10 different ways. What I will debate is BLTA is in a good position and shut down the naysayers saying blah blah blah.
