That wasn't the problem that I was talking about. When the CEO lets only certain investors know whether an article is real or fake, there is selective disclosure.
So, certain investors know whether the CEO's purported statement that an uplisting is "imminent" is true or false.
I, for one, found those words hugely comforting. Alas, they were fake.
At the end of the day, you are probably right though. The disclosure has to be material. Because the stock went up about 15% intraday because of the article, it may be material.
