You are correct. According to SEC records, John Commissiong has never purchased shares in the secondary market.

According to page 10 of the Schedule 14A Proxy filed on 8/19/14, Dr. John Commissiong held 20,464,636 shares , or 2.59% of the outstanding common stock as of 7/28/14.

On page 12 of the Proxy, the following statement appears, which explains why he has no Form 3 listed in the above link.

Section 16(a) Beneficial Ownership Reporting Compliance

Section 16(a) of the Securities Exchange Act of 1934, as amended, requires our directors and executive officers and persons who own more than 10% of the issued and outstanding shares of our common stock to file reports of initial ownership of common stock and other equity securities and subsequent changes in that ownership with the SEC. Officers, directors and greater than ten percent stockholders are required by SEC regulation to furnish us with copies of all Section 16(a) forms they file. To our knowledge, based solely on a review of the copies of such reports furnished to us and written representations that no other reports were required, during the fiscal year ended December 31, 2013 all Section 16(a) filing requirements applicable to our officers, directors and greater than 10% beneficial owners were complied with except that: Gerald Commissiong, Dr. John W. Commissiong, Marc E. Faerber, and Dr. Mark Benedyk, Robert L. Harris each failed to file a Form 3. A form 3 for Dr. David A. Lowe was not timely filed.
